The Federal High Court sitting in Abuja has officially granted bail to the former Executive Governor of Kaduna State, Mallam Nasir El-Rufai, in the sum of N100 million with one surety in like amount, following his arraignment over alleged breaches of national security.
Presiding Judge, Justice Joyce Abdulmalik, delivered the highly anticipated ruling on Monday morning after noting that the prosecution did not formally oppose the defense's application for bail.
Citing Section 36(5) of the 1999 Constitution of the Federal Republic of Nigeria, the court maintained that the defendant is legally presumed innocent until proven guilty by a court of competent jurisdiction throughout the period of his wiretapping trial
The trial stems from allegations connecting the former governor to the unauthorized interception and access of a private telephone conversation involving the National Security Adviser (NSA), Mallam Nuhu Ribadu.

In granting the application, Justice Abdulmalik attached highly stringent administrative conditions to guarantee El-Rufai's continuous presence in court.
According to the court order:
"The surety must reside in either Maitama or Asokoro districts of Abuja and is required to deposit the original Certificate of Occupancy of a landed property at the court registry. The court further directed that the surety must be a federal civil servant not below Grade Level 17 and provide evidence of salary payments for at least three months. These documents are to be authenticated by a letter from the surety’s bank manager within the court’s jurisdiction."
As part of the restrictive measures, El-Rufai was ordered to immediately deposit all his valid international travel passports with the Federal High Court registry, effectively barring him from traveling out of Nigeria without express judicial permission.
Furthermore, the surety must present a verifiable tax clearance certificate spanning the last six months alongside an official clearance letter from their immediate employer or federal department.
Most notably, Justice Joyce Abdulmalik directed the former governor to report physically to the national headquarters of the Department of State Services (DSS) in Abuja on the final Friday of every single calendar month at exactly 10:00 am to sign an official attendance register.
The court warned that any default or failure to strictly adhere to these guidelines would trigger an immediate and automatic revocation of his bail status.
The case has been adjourned for further hearing, with the court awaiting an official letter of attestation from the Chairman of the Kaduna State Traditional Council.
