A Kaduna State High Court has officially dismissed a fresh, high-profile bail application filed by the immediate past Governor of Kaduna State, Mallam Nasir Ahmad El-Rufai, after formally rejecting a medical report he relied upon as lacking any institutional credibility or legal authenticity.
Presiding Judge, Justice Darius Khobo, delivered the considered ruling on the criminal proceedings instituted against the former governor by the Independent Corrupt Practices and Other Related Offences Commission (ICPC).
El-Rufai's legal defense team had filed a third exceptional application for bail on severe medical grounds, appending a document labeled Exhibit “A” that claimed the prominent politician had been diagnosed with advanced metastatic prostate cancer requiring immediate specialized clinical treatment entirely unavailable anywhere within the Federal Republic of Nigeria.
"The court held that the evidential basis of the application collapsed after the medical report tendered by El-Rufai was formally repudiated by the management of the National Hospital, Abuja.
A comprehensive search of electronic medical records revealed no patient file, billing record, or consultation history," the ICPC confirmed in a public statement.
The Chief Medical Director of the National Hospital, Abuja, Professor Muhammad Raji Mahmud, issued a conclusive documentary disclaimer verifying that the medical report was compiled and printed completely without the knowledge, authorization, or administrative record of the medical center.
Justice Khobo subsequently ruled that a document formally disowned by its host institution cannot legally justify the exercise of judicial discretion in granting bail.
Despite the outright refusal, the High Court directed the anti-graft commission to grant the former governor unrestricted access to his verified personal medical physicians and mandated that security operatives escort the defendant to any certified diagnostic facility of his choice inside Nigeria whenever medical emergencies arise during the duration of the state trial.
