The prolonged leadership crisis rocking the Social Democratic Party (SDP) took a definitive turn on Friday as the Supreme Court nullified the Court of Appeal judgment previously used by the Independent National Electoral Commission (INEC) to recognize Shehu Gabam as the National Chairman of the party.
In a unanimous judgment delivered in suit SC/CV/229/2026 by Justice Garba, the apex court set aside the earlier decision of the Court of Appeal, Abuja Division.
The ruling effectively dismantles the entire legal foundation upon which INEC based its April administrative update listing the Gabam-led National Working Committee (NWC).
The legal battle originally stemmed from a suit filed by an SDP member, Fayemi Babatunde, who challenged the validity of the November 8, 2025, Ekiti State governorship primary election on the grounds that the party’s leadership structure was unlawfully constituted.

Following Friday's landmark judgment, leaders of the party loyal to Professor Abubakar Sadiq Gombe swiftly welcomed the decision, stating that the apex court has fully vindicated the authentic organs of the political party.
Addressing journalists in Abuja alongside former National Secretary Olu Agunloye and Senator Ugochukwu Uba, Professor Gombe emphasized that the ruling restores the party structure to its proper position under his leadership.
Gombe clarified that the Supreme Court’s decision strongly reaffirms that internal party affairs remain completely outside external judicial or administrative interference.
He further noted that the judgment respects the party’s National Executive Committee (NEC) decision, which had previously investigated and ratified Gabam's expulsion from the party following disciplinary proceedings that the latter failed to attend.
