A Federal High Court sitting in Abuja has officially struck out the lawsuit filed by former Transportation Minister Rotimi Amaechi, which sought to nullify the emergence of ex-Vice President Atiku Abubakar as the presidential candidate of the African Democratic Congress (ADC) for the 2027 general elections.
The ruling, delivered by Justice Joyce Abdulmalik on Friday, followed an application for discontinuance filed by Amaechi’s lead counsel, Jibrin Okutepa (SAN).
The legal battle, marked FHC/ABJ/CS/1215/2026, had centered on claims that the ADC’s primary election held on May 25 was conducted in breach of the Electoral Act 2026 and the party's own guidelines.
Amaechi had specifically alleged that the party failed to use a digital membership register for accreditation during the primary, a procedure he argued was mandatory.
After the matter was mentioned, Okutepa informed the court that the parties had successfully settled their differences, leading to the formal withdrawal of the suit.
With the case now struck out, the legal hurdle challenging Atiku Abubakar's candidacy on the ADC platform has been removed.
