Former Ekiti State Governor Ayodele Fayose has urged the Federal High Court in Lagos to dismiss the N6.9 billion fraud charges brought by the Economic and Financial Crimes Commission (EFCC), arguing there is no prima facie case against him. Justice Chukwujekwu Aneke reserved ruling on the no-case submission following arguments on May 19, 2025.
Represented by Chief Kanu Agabi (SAN), Fayose contended that the EFCC’s 11-count charge, which includes stealing and money laundering, rests on unsubstantiated predicate offences. “Criminal breach of trust and conspiracy are distinct charges, and no co-conspirator was docked with the defendant,” Agabi argued, noting that key figure Abiodun Agbele was not charged alongside Fayose.
Olalekan Ojo (SAN), counsel for second defendant Spotless Investment Ltd, reinforced the submission dated March 21, 2025, highlighting inconsistencies in the testimony of Senator Musiliu Obanikoro, the prosecution’s 13th witness. Ojo stressed that Obanikoro admitted there was no direct communication between Fayose and former NSA Col. Sambo Dasuki, undermining the prosecution’s narrative.
EFCC prosecutor Rotimi Jacobs (SAN) urged dismissal of the no-case plea, citing unexplained financial transactions and testimony that Fayose used intermediaries to purchase properties. “If the money was clean, why didn’t he acquire the properties in his name?” Jacobs questioned.
Justice Aneke granted Fayose permission to travel abroad for medical treatment and adjourned for ruling on July 10, 2025. The EFCC alleges Fayose took N1.2 billion for his 2014 campaign and $5 million in cash from Obanikoro, laundering over N1.6 billion through proxies in violation of the Money Laundering (Prohibition) Act.
