The National Broadcasting Commission (NBC) has filed a motion at the Court of Appeal in Abuja seeking leave to file a fresh appeal against a Federal High Court ruling that prohibited the regulatory body from imposing monetary fines on broadcast stations.
The new motion, filed by NBC counsel Dapo Akinosun (SAN), follows the Court of Appeal's June 17, 2026, decision that struck out the commission’s earlier appeal due to a clerical misnomer in its court filings.

The legal challenge stems from a suit filed by Media Rights Agenda (MRA) after the NBC levied N5 million fines on MultiChoice Nigeria, TelCom Satellite, Trust-TV, and NTA Startimes over documentary broadcasts concerning insecurity in Zamfara State.
In the January 10, 2024 judgment, Justice Rita Ofili-Ajumogobia ruled that the NBC lacked judicial powers to impose fines.
In its latest filing, the NBC argued that restricting its sanctioning authority creates uncertainty in broadcasting regulation, encouraging non-compliance and exposing the public to unverified or inflammatory content.
The commission is also seeking leave to challenge Media Rights Agenda’s legal standing to maintain the suit.
